I. General provisions

1.1 The reference institution educational complex "Kolkiv Secondary School of I-III Levels-Lyceum" was created by the decision of the Manevytsia District Council dated 30.06.2016  No. 10/2, according to the decision of the District Council dated 06.09.2011. No. 6/9 "On the List of Objects of Common Property of Territorial Communities of Villages and Settlements of the District" the rights of the founder of the institution belong to the Manevytsia District Council of the Volyn Region. The educational institution is based on property jointly owned by the territorial communities of villages and settlements of the district and belongs to the sphere of administration of the Manevytsk District Council, and on matters of implementation of state policy in the field of education - the Department of Education of the Manevytsk District State Administration.

1.2. The main institution educational complex "Kolkiv Secondary School of I-III Levels-Lyceum" is jointly owned by the territorial community of villages and towns of the district.

1.3. Legal address of the supporting educational institution educational and educational complex "Kolkiv Secondary School of I-III Levels-Lyceum": 44 661, Volyn Region, Manevytskyi District, Kolki Township,  street 3, Shkilna, phone number 3-27-40.

1.4.  The abbreviated name is the supporting institution of the NVK "Kolkivska ZOSH I-III st. - lyceum".

1.5. The reference institution educational complex "Kolkivsk general education school of I-III degrees-lyceum" (hereinafter referred to as the reference institution) is a legal entity, has an account with  Treasury authorities, independent balance sheet, stamp, seal, identification number and includes the following branches:

comprehensive school of I-II levels of the village Starosillya (with the function of a primary school);

comprehensive school of I-II levels of the village Retail (with the function of a primary school);

comprehensive school of I-II levels of the village Sytnytsia (functioning as a primary school);

secondary school of the first grade of the village Semky (functioning as an elementary school);

secondary school of the first grade of the village Novoukrayinka (functioning as an elementary school).

A branch is not a legal entity. Branches are endowed with the property of the founder and exist on the basis of the provisions approved by him. The branch performs the functions of an elementary school, as well as the functions of a primary school in accordance with the decision of the district council dated 30.06.2016  #10/2.

1.6.  The reference institution and its branches are part of the educational district.

1.7. The founder of the support institution is the Manevytsk District Council.

1.8. The main purpose and tasks of the support institution and its branches are:

- creation of a single educational space;

- creation of a unified system of educational work;

- ensuring equal access of individuals to quality education;

- creation of conditions for individuals to obtain general secondary education, introduction of pre-professional training and specialized training, in-depth study of individual subjects, provision of comprehensive development of a person, as well as pre-professional training regardless of their place of residence;

- development and application of modern pedagogical technologies, testing of educational innovations that significantly improve the results of the educational process;

- concentration and effective use of available material and technical resources, their direction to meet the educational needs of students;

- search, selection, training, upbringing and development of gifted and capable children.

In its activities, the reference institution is guided by the Constitution of Ukraine, the Laws of Ukraine "On Education", "On General Secondary Education", the Regulations on the Educational District, the decisions of the district council, this Statute, the regulations on branches, and other regulatory legal acts.

The reference institution independently makes decisions and carries out activities within the limits of its competence provided for by the legislation of Ukraine and its own Statute.

The reference institution is responsible to the individual, society and the state for:

  • safe conditions for educational activities;

  • compliance with state education standards;

  • compliance with contractual obligations with other subjects of educational, industrial, scientific activity, including obligations under international agreements;

  • compliance with financial discipline.

Ukrainian is the language of instruction in the reference institution.

1.9.  The reference institution has the right:

  • pass the state certification in the prescribed manner;

  • determine the forms, methods and means of organizing the educational process in agreement with the Department of Education of the Manevytsia District State Administration (hereinafter referred to as the Department of Education);

  • introduce in-depth study of subjects and learning profiles with the consent of parents and students;

  • determine the variable part of the working curriculum;

  • to develop and implement experimental and individual working training plans in accordance with the procedure established by the Law or by-laws;

  • develop conditions for competitive selection into lyceum classes taking into account the study profile;

  • jointly with higher educational institutions, scientific research institutes and centers to conduct research, experimental, research work that does not contradict the legislation of Ukraine;

  • use various forms of moral and material encouragement to the participants of the educational process;

  • to receive funds and material assets from executive authorities, legal entities and individuals in accordance with the procedure established by law;

  • to develop one's own social base: a network of sports and recreation, treatment and prevention, and cultural units;

  • highlight the activities of the educational institution on its own Internet site.

1.10.  In the reference institution, methodical associations are created and function: teachers of Ukrainian language and literature, mathematics and physics, foreign literature and Russian language, biology and chemistry, history and law, geography, English language , primary school teachers, class leaders, work training, physical education and protection of the Motherland, creative groups, practical psychologists and a social pedagogue work.

1.11. Medical care for students and the appropriate conditions for its organization are provided by the education department and are carried out by the nurse of the support institution and the medical staff of the paramedic-midwifery centers of the settlements in which the branches and the Manevytsia district center of primary health care are located.

1.12. The educational institution's relationship with legal entities and individuals is determined by agreements concluded between them.

1.13. The main institution and the branches within it have their own school symbols.

1.14. The reference institution is a non-profit organization.

 

II. Organization of the educational process

2.1. The reference institution and its branches plan their work independently according to long-term and annual plans.

The most important issues of the work of the educational institution are reflected in the work plans, and the prospects for its development are determined.

Work plans are approved by the board of the supporting institution.

2.2. The main documents regulating the educational process are working curricula, which are based on standard curricula developed and approved by the Ministry of Education and Science of Ukraine.

In accordance with the work curricula, teaching staff independently select programs, textbooks, teaching aids bearing the stamp of the Ministry of Education and Science of Ukraine, as well as scientific and methodical literature, didactic materials, forms, methods, educational work tools that must ensure the fulfillment of statutory tasks and obtaining an education at the level of state standards.

2.3. Pedagogical staff of lyceum classes can combine educational and educational work with scientific, methodical and experimental work, using, along with traditional methods and forms of organizing educational classes, innovative learning technologies, search and research work, including summer educational and research practice in agreement with the department of education.

2.4. In-depth training of students in lyceum classes and branch classes is achieved as a result of studying special courses, electives, elective courses, attending classes in circles; training of students according to individual curricula, search and educational research work can also be carried out.

2.5.  In order to improve the knowledge of students, the administration of the reference institution has the right to invite lecturers of higher educational institutions, practitioners, and scientific employees to read theoretical material, conduct practical classes, and summer educational and research practice under separate agreements.

2.6. The reference institution carries out the educational process in full-time, individual and external forms of education.

2.7. Enrollment of students in educational institutions of the educational district is carried out by order of the director of the reference institution on the basis of a personal statement (for minors - a statement of parents or their legal representatives), as well as a birth certificate (copy), a medical certificate of the established model, a document on the current level of education (except for children , who enter the first grade).

2.8. If necessary, the student can transfer to another educational institution during any year of study. The transfer of students to another educational institution is carried out in the presence of a student's personal file of the model established by the Ministry of Education and Science of Ukraine. Students who have received a basic general secondary education and passed the competition in accordance with the Admission Rules (interview, entrance exams, testing taking into account the students' choice of study profile), approved in the established order, are enrolled in lyceum classes. Tasks for entrance exams are developed and approved by the education department of the district state administration.

2.9. The structure of the academic year, as well as the weekly workload of students,
are established by the director of the reference institution and its branches within the time limit provided by the work training plans.

The support institution  and its branches work on a 5-day work week.

2.10.  It is prohibited to distract students from educational activities for other types of activities (except for cases stipulated by the legislation of Ukraine).

2.11.  In agreement with the education department of the regional state administration, taking into account local conditions, the specifics and profile of the educational institution, the vacation schedule is introduced. The duration of vacations during the academic year should not be less than 30 calendar days.

2.12.  The duration of lessons in educational institutions of the educational district (hereinafter - the educational institution) is: in the first grades - 35 minutes, in the second-fourth grades - 40 minutes, in the fifth-eleventh grades - 45 minutes Changing the duration of lessons is allowed upon agreement with the department of education and the sanitary-epidemiological service.

2.13. The daily number and sequence of educational classes is determined by the lesson schedule, which is drawn up for each semester in accordance with sanitary and hygienic and pedagogical requirements, agreed by the councils of educational institutions and approved by the director of the reference institution.

2.14. The weekly working hours of the reference school and its branches, the schedule of educational classes are approved by the director of the reference institution in agreement with the sanitary-epidemiological service.

In addition to various forms of compulsory classes, individual, group, optional and other extracurricular classes and events are held in educational institutions, provided for in a separate schedule and aimed at satisfying the educational interests of students and at developing their creative abilities, inclinations and gifts.

When conducting seminar, laboratory and  practical classes according to the lecture form of training in specialized disciplines, division into groups is introduced in lyceum classes  with a capacity of more than 27 students.

2.16. The number of classes and groups in the main institution and its branches,  the division in the study of specialized and other subjects is determined by the Ministry of Science and Education of Ukraine on the basis of the norms of financing of general secondary education established by the Cabinet of Ministers of Ukraine. At the expense of additional appropriations, the decision of the councils of educational institutions may establish a smaller number of classes and groups.

2.17. In the educational district, the level of students' academic achievements is determined in accordance with the current system for evaluating the educational achievements of students (students), and thematic accounting of knowledge is conducted.

In the first grade, a verbal description of the educational achievements of the students is given  and in the second grade according to the decision of the councils of educational institutions.

The education document (report cards, certificates, certificates) shows the academic achievements of students for semesters, the academic year and the state final certification.

The results of the semester, annual, and final evaluation are brought to the attention of the students by the class teacher (head of the certification commission).

2.18. The procedure for transferring and graduating students of educational institutions is carried out in accordance with the Procedure for transferring students (students) of a comprehensive educational institution to the next grade, approved by the order of the Ministry of Education and Science of Ukraine dated 07.14.2015  No. 762.

2.19. Control over the compliance of the educational level of students who have completed a certain degree of education with the requirements of the State Standard of General Secondary Education is carried out through state final certification. The procedure for conducting state final certification is determined by the Regulation on state final certification of students in the general secondary education system.

2.20. State certification of eleventh grade graduates is conducted  in accordance with the normative documents of the Ministry of Education and Culture of Ukraine.

2.21. The composition of the state certification commissions is created in accordance with the Regulation on the state final certification of students in the general secondary education system, approved by the order of the Ministry of Education and Science of Ukraine dated 12.30.2014  No. 1547.

Expulsion from lyceum classes of students who, according to the results of the annual assessment, have achieved an average level of competence (4-6 points) in more than 3 subjects is considered by the pedagogical council.

Pupils who have completed a certain degree of an educational institution are issued a corresponding educational document:

  • upon completion of primary school - report card 

  • upon completion of elementary school - certificate  of basic general secondary education;

  • upon graduation from the educational institution - certificate  of complete general secondary education.

2.22.  The following forms are established for success in the education of pupils (pupils)
moral and material encouragement:

students of grades 2-4, 5-8, 10 are awarded letters of commendation; 9th grade students are awarded with diplomas and a certificate of distinction; students of 11  grades are awarded with diplomas, gold and silver medals and the presentation of a certificate of a special model.

 

III. Participants of the educational process

3.1.    Participants in the educational process in educational institutions are:

  • pupils;

  • the director of the reference institution and heads of branches;

  • librarians, psychologists,  social teachers;

  • parents of students or their legal representatives.

3.2. The rights and obligations of students, teaching staff and other employees are determined by the current legislation and this Charter.

3.3. Students have the right to:

  • to choose a profile and form of education, electives, special courses, extracurricular and extracurricular activities;

  • for the use of the educational and industrial, scientific, material and technical cultural and sports, correctional and restorative and medical and health facilities of the educational district;

  • access to information from all fields of knowledge; participate in all types of scientific and practical activities, conferences, Olympiads, exhibitions, competitions, etc.;

  • participate in the work of public self-government bodies of the support institution or its branches;

  • participate in the discussion and make suggestions regarding the organization of the educational process, students' leisure time;

  • participate in voluntary amateur associations, creative studios, clubs, circles, interest groups, etc.;

  • for protection from any forms of exploitation, mental and physical violence that violate rights or humiliate their honor and dignity;

  • for safe and harmless conditions of education, upbringing and work.

3.4. Students are obliged to:

  • master knowledge, skills, practical skills, raise the general cultural level;

  • comply with the requirements of the Charter, rules of internal procedure; to treat state, public and personal property sparingly; comply with legislation, moral and ethical norms;

  • actively participate in various types of labor activities that are not prohibited by current legislation;

  • observe the rules of personal hygiene.

3.5.    Various forms of moral and material incentives are established for educational achievements for participants in the educational process of the reference institution. Pupils who have made significant achievements in education may be awarded a scholarship by decision of the board of the educational institution at the expense of their own funds or earmarked income from charitable foundations, societies, etc.

3.6. Pedagogical employees of an educational institution can be persons with high moral qualities, who have appropriate pedagogical education, an appropriate level of professional training, carry out pedagogical activities, ensure the effectiveness and quality of their work, and whose physical and mental health allows them to perform their professional duties.

3.7.  Appointment and dismissal:

- teaching staff and other employees of the supporting institution, heads of branches is carried out by the director of the supporting institution in accordance with  the labor legislation of Ukraine, the Law of Ukraine "On General Secondary Education" and other legislative acts in agreement with the education department;

-  teaching staff and other employees of branches  is carried out by the director of the supporting institution in accordance with  the legislation of Ukraine on work in the general education environment " and other legislative acts in agreement with the management of branches and the department of education.

3.8. Pedagogical workers have the right to:

  • protection of professional honor and dignity;

  • independent choice of forms, methods, means of educational work, in accordance with current legislation;

  • participation in the discussion and resolution of issues of the organization of the educational and labor process;

  • carrying out scientific research, experimental, search work in the prescribed manner;

  • identification of pedagogical initiative;

  • extraordinary attestation for the purpose of obtaining the corresponding pedagogical category, pedagogical title;

  • participation in the work of public self-government bodies of the educational institution; participation in various professional and professional competitions; professional development, retraining;

  • receiving a pension, including for years of service in accordance with the procedure determined by the legislation of Ukraine;

  • for material, housing and social security in accordance with current legislation;

Distraction of teaching staff from the performance of their professional duties is not allowed, except for cases stipulated by the legislation of Ukraine.

3.9.    Pedagogical employees of the reference institution and branches are obliged to:

  • to ensure the proper level of teaching of academic disciplines in accordance with educational programs at the level of mandatory state requirements;

  • to promote the development of children's interests, inclinations and abilities, as well as to preserve their health, to promote a healthy lifestyle;

  • contribute to the growth of the image of the educational institution;

  • by instruction and personal example, to establish respect for state symbols, principles of universal morality;

  • to educate students to respect parents, women, elders, national traditions and customs, spiritual and cultural heritage of the people of Ukraine;

  • to prepare students for independent life in the spirit of mutual understanding, peace, and harmony between all nations, ethnic, national, and religious groups;

  • adhere to pedagogical ethics, morality, respect the dignity of students;

  • protect students from any form of physical or mental violence, prevent their use of alcohol, drugs, tobacco, and other harmful habits;

  • to constantly improve one's professional level, pedagogical skill, general and political culture; to comply with the Statute of the supporting institution and the Regulations on the branch, rules of internal procedure, terms of the contract or employment contract;

  • to carry out the orders and instructions of the head of the educational institution, education management bodies;

  • participate in the work of the pedagogical council.

3.10.  In the supporting institution and its branches, the certification of pedagogical workers is mandatory. Attestation is carried out, as a rule, once every five years in accordance with the Standard Regulation on the attestation of pedagogical workers of Ukraine, approved by the Ministry of Science and Education of Ukraine. Attestation of pedagogical workers of the reference institution and its branches is carried out by the commission of the first level of the reference institution.

3.11. Pedagogical workers who systematically violate the Statute, the internal rules of the educational institution, do not fulfill their job duties, the conditions of the collective agreement (contract) or, according to the results of the certification, do not correspond to the position they hold, are dismissed from their jobs in accordance with the current legislation.

3.12.  Parents or legal representatives have the right:

  • elect and be elected to parent committees and public self-government bodies;

  • apply to the department of education, the director of the support institution, the head of the branch and public self-government bodies on issues of education and upbringing of children;

  • participate in activities aimed at improving the organization of the educational process and strengthening the material and technical base of the educational institution;

  • to protect the legitimate interests of their children in the public self-government bodies of the educational institution and in the relevant state and judicial bodies.

3.13.  Parents or persons who replace them are responsible for their children's acquisition of a complete general secondary education and are obliged to:

  • to provide conditions for the child to obtain a complete general secondary education in any form of education;

  • to constantly take care of the physical health and mental state of children, to create appropriate conditions for the development of their natural abilities;

  • to respect the dignity of the child, to cultivate industriousness, a sense of kindness, mercy, respectful attitude towards the Motherland, family, state and native languages, respect for the national history, culture, values of other peoples;

  • to raise children's respect for laws, rights, personal freedoms of a person.

3.14.  Public representatives have the right:

  • elect and be elected to public self-government bodies in the educational institution;

  • conduct consultations for teaching staff; participate in the organization of the educational process.

3.15.  Representatives of the public are obliged to comply with the Statute of the supporting institution and the Regulations on branches, to carry out orders and orders of the head of the educational institution, decisions of public self-government bodies, to protect students from all forms of physical and mental violence, to promote healthy lifestyle, harmful use of alcohol, tobacco, drugs, etc.

 

IV. Management of the educational institution

4.1. The governing body of the support institution is the Manevytsk District Council, and the Department of Education of the Manevytsk District State Administration is responsible for the implementation of state policy in the field of education.

4.2. The support institution is managed by the director. The director can be a citizen of Ukraine who has a higher pedagogical education at the specialist or master's level, with a teaching experience of at least 5 years. Branch management is carried out by branch managers.

The director of the support institution and his deputies are appointed and dismissed by the department of education. Appointment and dismissal of deputy directors is carried out at the request of the director in compliance with current legislation.

4.2.    The interests of the labor collective are represented by the trade union committee in accordance with the current legislation.

4.3.    The highest bodies of public self-governance of the support institution and its branches are general meetings of collectives (general meetings that are not convened), less than once a year.

Delegates of the general meeting (conference) with the right to vote are elected from the supporting institution and its branches:

  • employees of educational institutions - by meetings of labor collectives;

  • students of the second-third degree educational institution - by class meetings;

  • parents, representatives of the public - class parent meetings.

Each category elects the same number of delegates. The following number of delegates is determined: 50 from employees of educational institutions, 50 from students, 50 from parents and representatives of the public.

Their term of office is one year.

The general meeting (conference) is valid if at least half of the delegates from each of the three categories participate in its work. The decision is made by a simple majority of votes of the delegates present.

The right to convene a meeting (conference) belongs to the chairman of the board of the educational institution, the participants of the meeting (delegates of the conference), if at least one third of their total number, the director of the educational institution, the founder expressed their opinion.

4.4.  General meeting (conference):

  • elect the council and councils of educational institutions, its chairman, set the term of their powers; listen to the report of the director and chairman of the board of the educational institution; consider issues of educational and educational, methodical and financial and economic activity of the educational institution;

  • approve the main areas of improvement of the educational process, consider other important areas of activity of the educational institution;

  • make decisions on stimulating the work of managers and other pedagogical workers.

4.5. In the period between general meetings (conferences), the councils of the supporting institution and branches (hereinafter - the councils) operate.

4.5.1. The purpose of the council's activity is:

  • promotion of democratization and humanization of the educational process;

  • unification of efforts of pedagogical and student teams, parents, the public

  • regarding the development of the educational institution and improvement of the educational process;

  • formation of a positive image and democratic style of management of the educational institution;

  • expansion of collegial forms of educational institution management;

  • increasing the role of the public in solving issues related to the organization of the educational process.

4.5.2. The main tasks of the council are:

  • increasing the effectiveness of the educational process in interaction with the family, the public, state and private institutions;

  • determination of strategic tasks, priority areas of development of the educational institution and promotion of the organizational and educational process;

  • formation of healthy lifestyle skills;

  • creation of an appropriate pedagogical climate in an educational institution;

  • promoting the spiritual and physical development of students and their acquisition of social experience;

  • support of public initiatives to improve education and upbringing of students, creative searches and research and experimental work of teachers;

  • facilitating the organization of leisure time and improving the health of pupils (pupils);

  • support of public initiatives to create appropriate conditions and improve the process of teaching and educating students;

  • initiation of actions that would contribute to the steady implementation of the provisions of the current legislation regarding the obligation of general secondary education;

  • stimulation of moral and material encouragement of students, promotion of search, support of gifted children;

  • strengthening partnership relations between students' families and the general educational institution in order to ensure the unity of the educational process.

4.5.3. Representatives from the teaching staff, students of II-III degrees of education, parents and the public are elected proportionally to the council. Representation in the council and its total number are determined by the general meeting (conference) of the general educational institution.

The decision to terminate the work of a council member early for any reason is made exclusively by the general meeting (conference).

At the next election, the composition of the council is renewed by at least one third.

4.5.4. The council acts on the basis of:

  • the priority of human rights, the harmonious combination of the interests of the individual, society, and the state;

  • compliance with the requirements of the legislation of Ukraine;

  • collegiality of decision-making;

  • voluntary and equal membership;

  • publicity

4.5.5.  The Council works according to the plan approved by the general meeting (conference).

4.5.6.  The number of meetings is determined by their expediency, but must be at least four times per academic year.

The meeting of the council can be convened by its chairman or at the initiative of the director of the educational institution, the founder, as well as the members of the council. The decision of the council is made by a simple majority of votes, if at least two-thirds of its members are present at the meeting.

In case of an equal number of their votes, the vote of the chairman of the council is decisive.

Decisions of the council, which do not contradict the current legislation and the Charter of the educational institution, are brought to the attention of the teaching staff, students, parents or persons replacing them, and the public within the 7th day.

If the administration of the educational institution disagrees with the council's decision, a conciliation commission is created to consider the disputed issue.

The commission includes representatives of public self-government bodies, the administration, and the trade union committee of the educational institution.

4.5.7. The council is headed by the chairman, who is elected from among the members of the council.

The chairman of the council can be a member of the pedagogical council.

The head of the council cannot be the director, deputies and heads of branches.

To solve current issues, the council can create permanent or temporary commissions for certain areas of work. The composition of commissions and the content of their work are determined by the council.

Council members have the right to bring up for consideration all issues related to the activities of the educational institution, related to the organization of the educational process, health and mass cultural events.

4.5.8. Council:

  • organizes the implementation of decisions of general meetings (conferences);

  • makes suggestions regarding changes in the type, status, profile of education, study of foreign languages and languages of national minorities;

  • together with the administration, reviews and approves the work plan of the educational institution and supervises its implementation;

  • together with the administration, supervises the implementation of the Charter of the educational institution;

  • contributes to the formation of a network of classes of an educational institution, justifying its expediency in the bodies of executive power and local self-government;

  • together with the pedagogical council determines the expediency of choosing subjects of the variable part of the work curricula, taking into account the possibilities and needs of students, as well as the development trends of the region, society, and the state;

  • approves the work study plan for each academic year;

  • listens to the report of the chairman of the council, information of the director and his deputies on educational and financial and economic activities;

  • participates in the meetings of the certification commission to discuss the issues of assigning qualification categories to teachers;

  • submits to the Pedagogical Council proposals for improving the organization of extracurricular and extracurricular work with students;

  • acts as an initiator of charitable actions;

  • submits proposals for moral and material encouragement of participants in the educational process for consideration by the pedagogical council and the relevant education management body;

  • initiates consideration of personnel issues and participates in their resolution;

  • promotes the creation and operation of leisure centers, as well as involves the public, parents (or legal representatives) to participate in the management of clubs, other types of extracurricular and extracurricular activities, to conduct recreational and mass cultural events with students;

  • contributes to attracting  additional sources of funding;

  • considers the issue of family education;

  • participates, with the consent of parents, in surveying the living conditions of students who are in unfavorable socio-economic conditions; promotes pedagogical education of parents;

  • contributes to replenishment of the library fund and subscription to periodicals;

  • examines the issue of obtaining compulsory general secondary education by students;

  • organizes public control over food and medical care for students;

  • considers the appeals of the participants of the educational process regarding the work of the educational institution;

The composition of commissions and the content of their work are determined by the council.

4.6. Director of the reference institution:

  • manages teaching teams, ensures rational selection and placement of personnel, creates the necessary conditions for increasing the professional and qualification level of employees;

  • organizes the educational process;

  • ensures control over the implementation of educational plans and programs, the level of student achievements in education;

  • is responsible for the quality and efficiency of the work of the teaching staff;

  • creates the necessary conditions for the participation of students in extracurricular and extracurricular work, educational work;

  • ensures compliance with the requirements of childhood protection, sanitary and hygienic and fire prevention standards, safety equipment;

  • supports initiatives to improve the system of education and training, encouragement of creative searches, research and experimental work of teachers;

  • ensures students' rights to protection against any form of physical or mental violence;

  • is responsible for compliance by school employees with labor legislation;

  • hires, transfers and dismisses technical personnel;

  • keeps track of the movement of work books of employees of the reference institution, records of working time, issues orders on changes in the weekly workload of employees of the educational institution;

  • appoints class teachers who are in charge of classrooms, workshops, educational and research areas;

  • supervises the organization of food and medical care for students;

  • controls and is responsible for the timely submission of lists of employees subject to medical examination to the medical institution;

  • manages school property and funds in accordance with the procedure established by the founder;

  • issues orders and orders within its competence and monitors their execution;

  • in agreement with the trade union committee, approves the rules of the internal procedure, job duties of the employees of the educational institution;

  • supervises the transportation of students to the reference institution;

  • creates conditions for the creative growth of pedagogical workers, their search and application of effective forms and methods of teaching and education;

  • is responsible for its activities to students, parents, teaching staff and general meetings (conference), the founder, local bodies of state executive power, etc.

4.7. Branches of the reference institution are managed by branch managers and their deputies.

4.8.  Branch manager:

  • organizes the educational process of the branch;

  • initiates before the head of the reference institution the selection of the work study plan and the distribution of the weekly workload of the teaching staff;

  • ensures control over the implementation of educational plans and programs, the level of student achievements in education;

  • is responsible for the quality and efficiency of the work of the teaching staff;

  • creates the necessary conditions for the participation of students in extracurricular and extracurricular work, educational work;

  • ensures compliance with the requirements of childhood protection, sanitary and hygienic and fire prevention standards, safety equipment;

  • supports initiatives to improve the system of education and training, encouragement of creative searches, research and experimental work of teachers;

  • ensures students' rights to protection against any form of physical or mental violence;

  • supervises the organization of food and medical care for students;

  • issues orders and orders within its competence and monitors their execution;

  • supervises the transportation of students to the reference institution;

  • creates conditions for the creative growth of pedagogical workers, their search and application of effective forms and methods of teaching and education;

  • is responsible for its activities to students, parents, teaching staff and general meetings (conference), the founder, local bodies of state executive power, etc.

4.9. The amount of pedagogical workload of teachers is determined on the basis
labor legislation and the work curriculum of the reference institution and its branches by the director of the reference institution in agreement with the management of the branches  and approved by the relevant education management body.

4.10.  Changes in the amount of teaching workload of employees assigned to the full tariff rate are carried out  with the written consent of the employee.

Redistribution of the teaching load during the academic year is allowed in the case of a change in the number of hours in individual subjects, which is provided for by the working curriculum, or with the written consent of the teaching staff in compliance with labor legislation.

4.11. A permanent body of collective decision-making is created in the reference institution - the pedagogical council.  The head of the reference institution is the head of the pedagogical council.

The Pedagogical Council of the reference institution considers the following issues:

  • improvement and methodological support  of educational
    process;

  • planning and mode of operation of the institution;

  • variable component of the working curriculum;

  • притягнення до    дисциплінарної  _cc781905-5cde-3194-bb3b- 136bad5cf58d_ відповідальності    учнів  (вихованців), _cc781905-5cde -3194-bb3b-136bad5cf58d_ працівників  закладу  за  невиконання  ними_cc781905-5cde-3194-bb3b- 136bad5cf58d_ of their duties.

The Pedagogical Council is also considering other issues related to
activity of the institution.

4.11.1. A small pedagogical council is created in branches (university educational institutions of I-II levels).

The small pedagogical council performs the following functions:

  • informational and analytical,

  • diagnostic,

  • communicative,

  • methodical  

The small pedagogical council considers the following issues:

- improvement and methodological support of the educational process;

- considers and initiates petitions before the pedagogical council of the supporting institution on the issue of:

- transfer of students to the next class and their graduation, issuing of documents on the appropriate level of education, awards for educational achievements;

- improving the qualifications of pedagogical workers, developing their creative initiative, introducing scientific achievements and advanced pedagogical experience into the educational process;

- moral and material encouragement of students and employees of the educational institution.

4.12.  The work of the pedagogical council is planned in an arbitrary manner in accordance with the needs of the educational institution.

The number of meetings of the pedagogical council is determined by their expediency, but cannot be less than four times a year.

Members of the Pedagogical Council have the right to bring up for consideration relevant issues of the educational process.

4.13.  Class meeting:

  • elect the student self-government bodies of the class;

  • nominate their representatives to participate in the work of the general meetings of the educational institution;

  • discuss the organization of education, activities and leisure time of the student body.

4.14.  Parents’ meeting of the class is a collective body of parental self-government:

  • parents' self-government bodies are elected - parents' committee;

  • elect their representatives for the work of the general meeting;

  • submit proposals regarding the organization of the educational process in the classroom and educational institution to the consideration of the general meeting, the pedagogical council, the director and his deputies;

  • invite teachers, a psychologist, representatives of the administration of the lyceum school to discuss the state and prospects of the class, the educational institution, as well as to clarify certain issues that concern parents.

Heads of educational institutions (director of the main institution and his deputies, heads of branches and their deputies), governing bodies (general meetings, council, pedagogical council, small pedagogical council, parents' meetings, student meetings,  parent committee ) act within the scope of the powers defined by the Laws of Ukraine "On Education", "On General Secondary Education", the Regulation on Secondary General Educational Institutions, approved by the Resolution of the Cabinet of Ministers of Ukraine No. 660 dated 19.08.93, the Regulation on the Educational District, approved by the Resolution of the Cabinet of Ministers of Ukraine dated August 27, 2010 No. 777, its own charter and instructions on the organization and activities of the educational institution.

The staff list of the support institution is approved by the education department of the district state administration in accordance with the current legislation, production needs and financial capabilities of the support institution and its branches. Pedagogical workers can be hired according to employment contracts, including on a competitive basis.

The administration of the reference institution and its branches is organized in accordance with the procedure defined by the current legislation of Ukraine.

The reporting of the educational institution is established in accordance with the requirements of current legislation and state statistics.

4.15.  Student and teacher public organizations operating in accordance with the current legislation of Ukraine may be established in the supporting institution and its branches.

 

V. Material and technical base

5.1.    The material and technical base of the support institution and its branches includes buildings, structures, equipment, land, communications office housing, other material assets, the value of which is reflected in the balance sheet of the educational institution.

5.2.    The property of the educational institution belongs to it with the right of operational management in accordance with the current legislation, the charter and agreements concluded with the educational institution.

5.3. The reference institution is the legal successor of the rights, obligations and property of the schools:

general education  school of the I-II levels of the village. Old Town;

secondary school of grades I-II of the village Retail;

secondary school of grades I-II of the village Sytnitsa;

secondary school of the first grade of the village Seeds;

secondary school of the first grade of the village Novoukrainka

5.4.  The reference institution and its branches use land and other natural resources in accordance with current legislation and are responsible for compliance with the requirements and norms of their protection.

Seizure of fixed assets, working capital and other property of educational institutions is carried out only in cases provided for by current legislation. Damages caused to the educational institution as a result of violation of its property rights by other legal entities and individuals shall be compensated in accordance with the current legislation.

To ensure the educational process, the base of educational institutions consists of classrooms, workshops (locksmith, turning, service work, etc.), as well as sports, assembly and reading halls, a library, an archive, a radio center, medical and computer rooms, a dining room and cafeteria, premises for engineering and technical and educational support staff, rooms for psychological relief, etc.

5.5. The reference institution and its branches  have land plots where sports and geographical grounds, farm buildings, etc. are located.

5.6. The support institution has a pre-school boarding school for students from the surrounding villages.

 

IV. Financial and economic activity

6.1.    The financial and economic activity of the supporting institution and its branches is carried out on the basis of its estimate.

6.2.    The sources of the estimate of the reference institution and its branches are:

  • funds of the founder;

  • funds from the state budget in the amount stipulated by the general secondary education funding regulations to ensure the study of subjects within the scope of the State Education Standards;

  • funds received for the provision of paid services;

  • income from the sale of products of educational and production workshops, educational and research sites, auxiliary farms, from renting out premises, buildings, equipment;

  • charitable contributions of individuals and legal entities;

  • other sources not prohibited by current legislation.

6.3. The institution is forbidden to distribute the received income (profits) or their parts among the founders (participants), employees (except for the payment of their work, the calculation of a single social contribution), members of management bodies and other persons related to them.

 The use of income (profits) is carried out exclusively for the financing of expenses for the maintenance of the institution, the realization of the purpose (goals, tasks) and directions of activity defined by this Statute.

6.4. The reference institution has the right to purchase and rent the necessary equipment and other material resources, to use the services of any enterprise, institution, organization or individual, to finance from its own income measures that contribute to the improvement of the social and living conditions of the staff of the reference institution and its branches.

6.5. The order of record keeping and accounting in the reference institution and its branches is determined by the legislation and normative legal acts of the Ministry of Education and Science of Ukraine and other central bodies of executive power to which educational institutions are subordinate. Reporting on the activities of the reference institution and its branches is established in accordance with the legislation.

VII. international cooperation

7.1. In the presence of the appropriate material, technical and socio-cultural base and own income, the supporting institution has the right to conduct international student and pedagogical exchange within the framework of educational programs and projects, to establish direct relations with international organizations and educational associations in accordance with the law.

7.2. The reference institution has the right, in accordance with the current legislation, to enter into cooperation agreements with educational institutions, scientific institutions, enterprises, organizations, and public associations of other countries.

 

VIII. Control over the activities of the educational institution

8.1. State control over the activities of the reference institution and its branches is carried out in order to ensure the implementation of a unified state policy in the field of general secondary education.

8.2. State control is carried out by the Ministry of Education and Science of Ukraine,   the Department of Education, Science and Youth of the Volyn Regional State Administration and the Department of Education of the Manevytsia District State Administration.

8.3. The main form of state control over the activities of the reference institution and its branches is certification, which is carried out at least once every ten years in accordance with the procedure established by the Ministry of Education and Science of Ukraine.

8.4. In the period between attestations, the reference institution and its branches are inspected on issues related to its educational activities. The content, types and frequency of these inspections are determined depending on the state of educational work, but not more often than 1-2 times a year. Inspections on matters unrelated to educational activities are conducted by its founder in accordance with legislation.

 

THEM Reorganization or liquidation of an educational institution

9.1. The decision on reorganization or liquidation of the supporting institution and its branches is taken by the founder.

Reorganization or liquidation of a reference institution and its branches takes place  on the grounds and in the manner prescribed by current legislation.

9.2. In case of reorganization, the rights and obligations of the educational institution are transferred to the successors in accordance with the current legislation.

9.7. The liquidation is considered completed, and the supporting institution as having ceased its activity, from the moment of its exclusion from the state register. 9.8.
